TERMS AND CONDITIONS

Welcome to Blazing Creations. These Terms and Conditions (“Terms”) govern your access to and use of the Blazing Creations website located at https://blazingcreations.com (the “Site”), including the purchase of our products and services through our online store and event-booking system.
By accessing the Site, placing an order, booking an event service, or otherwise using our services, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree with these Terms, please discontinue use of the Site and our services.
Blazing Creations is operated by Blazing-Creations Party Needs and Souvenir Shop, a business registered and operating in the Philippines.

1. SCOPE OF SERVICES
1.1 E-Commerce Store
Blazing Creations sells physical consumer products through its online store, including souvenirs, party needs, customized products, wedding-related products, and other products displayed on the Site.
Products may be available for delivery within the Philippines, subject to the delivery locations and conditions indicated at checkout.
1.2 Event Booking Services
Blazing Creations also provides event-related services within the Bicol Region, including but not limited to:
- Camarines Sur
- Albay
- Sorsogon
- Camarines Norte
- Catanduanes
- Masbate
The availability, scope, inclusions, pricing, and conditions of an event service will depend on the specific service selected and the booking confirmation issued by Blazing Creations.
1.3 Separate Policies
Certain transactions may be subject to additional terms or policies, including our:
- Return & Refund Policy
- Privacy Policy
- Event Booking and Cancellation Policy
- Shipping and Delivery Policy, where applicable
These policies form part of these Terms where applicable to the relevant transaction.
2. PRODUCT INFORMATION AND AVAILABILITY
2.1 Product Descriptions
We make reasonable efforts to ensure that product names, descriptions, photographs, dimensions, colors, materials, prices, and other information displayed on the Site are accurate and up to date.
However, slight differences in color or appearance may occur due to photography, lighting, display settings, or device screens.
2.2 Product Availability
Products are subject to availability. We reserve the right to correct errors, update product information, or discontinue products when necessary.
If an order has already been paid for and Blazing Creations is unable to fulfill it, we will notify the customer and provide the applicable remedy, which may include a replacement, alternative product, or refund, subject to applicable law and our Return & Refund Policy.
2.3 Customized Products
For customized or personalized products, customers are responsible for providing accurate information, including names, dates, spelling, addresses, photographs, designs, measurements, and other specifications required to complete the order.
Where Blazing Creations provides a design proof for customer approval, the customer is responsible for carefully reviewing the proof before approving production.
Changes requested after production has begun may result in additional charges, additional production time, or both.
Nothing in this section limits any consumer rights or remedies that cannot lawfully be excluded under Philippine law.
3. PRICES, TAXES, AND CURRENCY
3.1 Currency
All prices displayed on the Site are stated in Philippine Peso (PHP) unless expressly stated otherwise.
3.2 Applicable Charges
The applicable product or service price, shipping or delivery charge, and other applicable charges will be disclosed to the customer before payment is completed.
3.3 Taxes
Applicable taxes will be treated and reflected in accordance with Blazing Creations’ applicable Philippine tax registration and BIR requirements.
Blazing Creations does not represent that all transactions are subject to VAT. Where applicable, the corresponding BIR-compliant invoice will reflect the appropriate tax treatment.
3.4 Price Changes
Prices may change without prior notice. However, a price change will not retroactively change the agreed price of an order or booking that has already been confirmed, except where required by law or agreed upon by the customer.
3.5 Pricing Errors
If an obvious pricing or product information error occurs, Blazing Creations may contact the customer to clarify the correct price or information before fulfillment.
If an order has already been paid and cannot reasonably be fulfilled at the displayed price because of an obvious error, Blazing Creations may cancel the affected order and provide an appropriate refund.
4. ORDERS AND ACCEPTANCE
4.1 Placing an Order
Placing an order through the Site constitutes the customer’s request to purchase the selected products or services.
4.2 Order Confirmation
An automated order confirmation or payment notification confirms that the order or payment request has been received. It does not necessarily mean that Blazing Creations has accepted the order for fulfillment.
An order becomes confirmed when Blazing Creations has accepted the order and, where applicable, verified the required payment and order details.
4.3 Order Cancellation by Blazing Creations
Blazing Creations may decline or cancel an order for legitimate reasons, including:
- product unavailability;
- obvious pricing or description errors;
- inability to fulfill the order;
- suspected fraudulent or unauthorized transactions;
- incomplete or materially inaccurate information;
- inability to verify a transaction; or
- circumstances that make fulfillment unlawful or impracticable.
If payment has already been received for an order that Blazing Creations cancels, the applicable amount will be refunded in accordance with our Return & Refund Policy and applicable law.
5. EVENT BOOKING AND DOWN PAYMENT
5.1 Event Information
Customers are responsible for providing accurate event information, including:
- event date;
- event time;
- venue;
- contact person’s name;
- contact information;
- access instructions; and
- other information reasonably necessary for the performance of the service.
5.2 Advance Booking
Event bookings may be subject to minimum advance-booking requirements and availability restrictions displayed during the booking process.
A selected date is not considered permanently secured until the booking has been accepted by Blazing Creations and the required payment has been successfully received.
5.3 50% Down Payment
Unless a different payment arrangement is expressly stated for a particular service, event bookings require a 50% down payment to secure the booking.
The remaining balance must be paid according to the payment schedule stated in the booking confirmation, invoice, or applicable Event Booking and Cancellation Policy.
5.4 Booking Confirmation
A booking confirmation may include the event date, event time, venue, selected services, amount paid, remaining balance, payment deadline, and other applicable conditions.
Customers should carefully review the booking confirmation and immediately notify Blazing Creations of any error.
5.5 Customer-Caused Cancellation or No-Show
If inaccurate or incomplete information, lack of required venue access, failure to obtain necessary permissions, failure to provide reasonable access to the event venue, or another circumstance attributable to the customer prevents Blazing Creations from providing the booked service, the booking may be treated as a customer-caused cancellation or no-show.
Any cancellation charges, forfeiture of amounts paid, rescheduling rights, or refund will be determined in accordance with the applicable Event Booking and Cancellation Policy and Philippine law.
5.6 Blazing Creations Cancellation
If Blazing Creations is unable to provide a confirmed event service for reasons attributable to Blazing Creations, the customer will be informed as soon as reasonably practicable and will be offered the applicable remedy under the booking agreement, including rescheduling or refund where appropriate.
6. PAYMENTS THROUGH PAYMONGO
6.1 Payment Gateway
Online payments may be processed through PayMongo and the payment methods made available through the PayMongo integration on the Site.
Available payment methods may include cards, e-wallets, online banking, QR-based payment methods, or other payment methods made available by PayMongo from time to time.
Payment-method availability may change and is subject to PayMongo’s and the relevant payment provider’s availability and requirements.
6.2 Payment Authorization
By submitting a payment, the customer authorizes the applicable payment provider to process the transaction for the amount displayed at checkout.
6.3 Payment Information
Payment card and other payment credentials are processed through PayMongo and/or the applicable payment service provider.
Blazing Creations does not intentionally store customers’ complete payment-card credentials on its own website servers. Payment processing is subject to the applicable security standards, terms, and policies of PayMongo and the relevant payment provider.
6.4 Payment Confirmation
An order will not be treated as paid solely because a customer has initiated a payment. Payment must be successfully confirmed through the applicable payment system.
6.5 Failed or Reversed Payments
If a payment fails, is reversed, cancelled, or otherwise does not successfully settle, Blazing Creations may suspend or cancel the affected order or booking until valid payment is received.
6.6 Refunds Through PayMongo
Where a refund is approved under our Return & Refund Policy, booking policy, or applicable law, the refund will generally be processed through the original payment method where technically available.
Refund processing time may vary depending on the payment method and payment provider. Certain payment methods may have specific refund restrictions or processing periods.
Where the original payment method cannot technically receive the applicable refund, Blazing Creations may use another lawful refund method.
PayMongo’s technical refund limitations do not restrict any consumer right or remedy that cannot lawfully be excluded under Philippine law.
6.7 Payment Disputes and Chargebacks
Payment disputes or chargebacks initiated through a card issuer or payment provider are subject to the applicable payment-network and payment-provider rules.
Customers are encouraged to contact Blazing Creations first regarding legitimate payment or order concerns so that we may investigate and, where appropriate, provide the applicable remedy.
Nothing in this section prevents a customer from exercising rights available under applicable Philippine law.
7. SHIPPING AND DELIVERY
7.1 Delivery Areas
Blazing Creations may deliver products to locations within the Philippines through third-party delivery or courier providers.
Available delivery locations, delivery charges, and applicable restrictions will be displayed or communicated before order completion where practicable.
7.2 Delivery Times
Delivery estimates are provided for guidance only. Actual delivery times may vary due to courier operations, weather, holidays, remote-area delivery, transportation disruptions, address issues, and other circumstances beyond our reasonable control.
7.3 Customer Responsibility
Customers are responsible for providing an accurate and complete delivery address and contact information.
Additional delivery charges may apply when a parcel cannot be delivered because of an incorrect or incomplete address or other circumstances attributable to the customer.
7.4 Damaged, Missing, or Incorrect Orders
Customers should promptly contact Blazing Creations if an order is:
- damaged;
- missing;
- incomplete;
- materially different from what was ordered; or
- otherwise not received in the condition or form required by the applicable agreement.
Blazing Creations will investigate the concern and provide the applicable remedy under our Return & Refund Policy and Philippine law.
7.5 Courier Delays
Blazing Creations will exercise reasonable care in preparing and handing orders to the selected delivery provider.
However, delays caused solely by third-party courier operations or circumstances beyond our reasonable control may not be within Blazing Creations’ ability to prevent.
Nothing in this section limits any consumer right or remedy provided by applicable Philippine law.
8. RETURNS, REFUNDS, AND CONSUMER RIGHTS
8.1 Applicable Law
Our return and refund practices are intended to comply with applicable Philippine consumer-protection laws, including Republic Act No. 7394 (Consumer Act of the Philippines) and Republic Act No. 11967 (Internet Transactions Act of 2023).
The Internet Transactions Act provides online consumers with remedies, including repair, replacement, refund, or other remedies provided by law where goods or services are defective, lost without the consumer’s fault, or otherwise fail to conform to the applicable agreement.
8.2 Defective, Damaged, or Nonconforming Products
If a product is defective, damaged before delivery, materially different from the product ordered, or otherwise fails to conform to the applicable contract or legal requirements, the customer may be entitled to repair, replacement, refund, price reduction, or another remedy as provided by applicable law and our Return & Refund Policy.
8.3 Change of Mind
A customer’s change of mind does not automatically create a statutory right to a refund or exchange in every transaction.
Any voluntary return, cancellation, or exchange for reasons other than a defect, damage, nonconformity, or other legally recognized ground will be subject to our Return & Refund Policy and the applicable terms disclosed before purchase.
8.4 Customized Products
Because customized products are produced according to customer-provided specifications, returns or cancellations based solely on a change of mind may be subject to additional restrictions disclosed in our Return & Refund Policy.
These restrictions do not remove rights or remedies available under applicable Philippine law for defective, damaged, or materially nonconforming products.

Customers may be asked to provide the order number, photographs, videos, delivery information, or other reasonable documentation necessary to investigate the concern.

9. INVOICES AND TRANSACTION RECORDS
Blazing Creations will issue the applicable paper or electronic invoice in accordance with Philippine tax and invoicing requirements.
For Non-VAT transactions, the applicable Non-VAT invoice will be issued where required under applicable BIR rules.
Customers may request an invoice where applicable. BIR regulations provide specific invoicing requirements for VAT and Non-VAT taxpayers.
Order confirmations, invoices, payment confirmations, delivery records, booking records, and relevant customer communications may be retained as transaction records in accordance with applicable legal, tax, accounting, payment-provider, and data-protection requirements.
10. CUSTOMER RESPONSIBILITIES
Customers agree to:
- provide accurate and complete information;
- use the Site only for lawful purposes;
- provide accurate shipping and event information;
- review order and booking details before payment;
- provide accurate information required for customized products;
- make required payments by the applicable deadlines;
- provide reasonable cooperation necessary for delivery or event-service fulfillment; and
- promptly notify Blazing Creations of material errors or concerns regarding an order or booking.
Customers must not use the Site for fraudulent, unlawful, abusive, or unauthorized activities.
11. DATA PRIVACY
11.1 Privacy Policy
Personal information collected through the Site is processed in accordance with our Privacy Policy, Republic Act No. 10173 (Data Privacy Act of 2012), its implementing rules and regulations, and applicable National Privacy Commission issuances.
11.2 Lawful Processing
Depending on the circumstances, personal information may be processed on the basis of consent where required, performance of a contract, compliance with a legal obligation, or another lawful basis recognized under applicable Philippine law.
The Data Privacy Act recognizes, among others, consent, contractual necessity, and legal obligation as lawful bases for processing personal information.
11.3 Purposes of Processing
Personal information may be processed for purposes including:
- processing and fulfilling orders;
- processing event bookings;
- payment coordination;
- delivery;
- customer support;
- communicating with customers;
- accounting and invoicing;
- fraud prevention and transaction security;
- compliance with legal and regulatory requirements; and
- other purposes disclosed in our Privacy Policy.
11.4 Data Sharing
Where reasonably necessary, information may be shared with service providers such as payment processors, courier providers, hosting providers, technology providers, professional advisers, and other service providers involved in fulfilling an order or service, subject to applicable privacy requirements.
11.5 Customer Rights
Customers have rights under applicable data-protection laws, subject to applicable legal limitations. Further information regarding data collection, use, retention, security, sharing, and data-subject rights is provided in our Privacy Policy.
12. INTELLECTUAL PROPERTY
All content appearing on the Site, including text, photographs, graphics, logos, designs, product images, videos, downloadable materials, website layouts, and other original content, is owned by or licensed to Blazing Creations unless otherwise indicated.
Such content may be protected by applicable Philippine intellectual-property laws, including Republic Act No. 8293 (Intellectual Property Code of the Philippines), as amended.
Customers may not reproduce, copy, distribute, modify, publish, sell, or commercially exploit Site content without prior written permission, except where permitted by applicable law.
13. THIRD-PARTY SERVICES AND LINKS
The Site may use or link to third-party services, including payment providers, courier services, hosting providers, analytics services, social-media platforms, or other third-party services.
Third-party services are governed by their respective terms, policies, and privacy practices.
Blazing Creations is not responsible for independent policies or practices of third parties, except to the extent required by applicable law or where Blazing Creations is otherwise responsible for the relevant transaction or service.
14. LIMITATION OF LIABILITY
14.1 Circumstances Beyond Reasonable Control
To the extent permitted by applicable Philippine law, Blazing Creations will not be responsible for delays or failure to perform caused solely by circumstances beyond our reasonable control, including natural disasters, severe weather, government restrictions, transportation disruptions, telecommunications or internet outages, widespread system failures, or other events that could not reasonably have been prevented.
14.2 Statutory Rights Preserved
Nothing in these Terms excludes, restricts, or limits any liability, warranty, consumer right, remedy, or obligation that cannot lawfully be excluded or limited under Philippine law.
Nothing in these Terms is intended to waive or diminish rights available to consumers under applicable consumer-protection, e-commerce, privacy, or other laws.
15. CUSTOMER COMPLAINTS AND INTERNAL REDRESS

We will make reasonable efforts to review and resolve legitimate complaints promptly.
Our internal redress mechanism is intended to provide customers with an accessible means of resolving transaction concerns.
Under the Internet Transactions Act, an online consumer is generally expected to avail of the applicable internal redress mechanism before filing a complaint before a court or appropriate government agency, and the mechanism is deemed exhausted if the complaint remains unresolved after seven (7) calendar days from filing.
Nothing in this section prevents a customer from exercising a right or remedy that cannot lawfully be restricted.
16. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.
Customers and Blazing Creations are encouraged to first attempt to resolve disputes through direct communication and our internal redress mechanism.
Nothing in these Terms prevents a customer from filing a complaint with the appropriate government agency, tribunal, or court where such right is available under Philippine law.
Subject to applicable law and jurisdictional rules, disputes that are properly brought before a court may be filed before a competent court having jurisdiction in Naga City, Camarines Sur, or such other venue as may be required or permitted by applicable law.
17. MODIFICATION OF THESE TERMS
Blazing Creations may update these Terms from time to time to reflect changes in our products, services, payment processes, business practices, or applicable laws and regulations.
The revised Terms will be posted on the Site with an updated Effective Date.
Changes will generally apply to transactions made after the revised Terms become effective and will not retroactively alter confirmed transactions except where required by applicable law or agreed upon by the parties.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
18. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a competent authority, the remaining provisions will continue to the extent permitted by law.
The invalid or unenforceable provision shall be interpreted or modified to the minimum extent necessary to make it valid and enforceable while preserving its intended purpose, where legally permissible.
19. ENTIRE AGREEMENT
These Terms, together with the applicable product or service descriptions, order confirmation, booking confirmation, Return & Refund Policy, Privacy Policy, and other policies expressly incorporated into these Terms, constitute the agreement governing the relevant transaction between the customer and Blazing Creations.
Where a specific written agreement or booking confirmation contains terms specifically applicable to a particular transaction, those transaction-specific terms will govern to the extent they do not conflict with mandatory provisions of Philippine law.
